Third-party bodily injury
Third-party bodily injury (TPBI) is injury or death caused to someone other than the driver at fault, and a TPBI claim is the injured person’s claim against that driver’s insurer.
Malaysian law requires motor vehicles to carry insurance, and once a policy is in force the insurer must satisfy a valid judgment for a third party’s death or bodily injury.[1] That is why a hurt rider, passenger, pedestrian or other road user usually ends up dealing with an insurance company rather than suing the other driver personally.
A TPBI claim covers the person, not the vehicle. Damage to a car, motorcycle or property is handled separately as an own-damage or property claim, with its own rules and its own insurer.
