Loss of earning capacity
Loss of earning capacity is compensation for a lasting reduction in your ability to earn in future, separate from the income you have already lost.
It matters most where an injury has not yet cost you a pay cut but limits the jobs you can safely do, your promotion prospects, or how long you can keep working. Malaysian law values future loss using the claimant’s income at the time of injury and an age-based formula, with an upper age limit of 60 for the underlying claim.[1]
